TERMS AND CONDITIONS OF SALE
Please read carefully the present General Conditions of Sale of IRIS NOBLE.
irisnoble.com is published by the company IRIS NOBLE, whose registered office is located at 31, Pl. Marché Saint-Honoré, 75001 Paris, registered with the Paris Trade and Companies Register under number 809 982 820, its intra-community VAT number is FR 17809982820.
The irisnoble.com internet site can be used to order a selection of IRIS NOBLE products from IRIS NOBLE thanks to a distance selling system (email or telephone by dialing 00 33 (0)1 42 03 58 43).
The General Conditions of Sale detailed below apply to all the orders placed by email or telephone with the IRIS NOBLE company for all the products and services proposed on the irisnoble.com site. They are accessible at any time on the website.
The IRIS NOBLE products are exclusively intended to be sold to final consumers natural or legal persons, with the exclusion of all retailers or intermediaries acting on behalf of retailers. Any resale or distribution of IRIS NOBLE products purchased on the eboutique-irisnoble.com internet site is strictly subject to prior written authorization from the IRIS NOBLE company.
IRIS NOBLE can at any time update these General Conditions of Sale. The General Conditions of Sale in force on the irisnoble.com Internet site at the time of the conclusion of the sale contract are those which are opposable to you. Consequently, placing an order implies full acceptance, without reservation, of these General Sales Conditions.
I - CUSTOMER
When the customer registers his personal data, the Customer must ensure the exactitude and the exhaustiveness of the data which it provides. In the event of error in the wording of the co-ordinates of the recipient, establishment IRIS NOBLE could not be held responsible for the impossibility of delivering products.
II - PRODUCTS
The products proposed with the sale are those described on the site at the day of the consultation of the site by the customer, within the limit of stocks available. Company IRIS NOBLE takes the greatest care in the presentation and the description of these products on the site on line before the confirmation of the order to satisfy as well as possible the information of the customer. It is however possible that errors may appear, which the customer recognizes and accepts.
In the event of a product delivered not in conformity with its description, the customer can exercise his right of retractation, or to profit from the guarantee of conformity of IRIS NOBLE, which, if necessary, will proceed to an exchange or a refunding of the invoiced price. To be taken into account, the products must be turned over intact, not worn, in their state of origin, with their packing of origin.
In the event of non-conformity, the customer has 5 days from receipt of the order to report the non-conformity by e-mail.
In spite of the best efforts undertaken so that the colors, the design and the style of the IRIS NOBLE products on the photographs presented on the irisnoble.com Internet site are representative of the original products, variations of colors can appear because of the technical constraints of interpretation of the colors of your data-processing equipment. IRIS NOBLE reserves the right to refuse or cancel your order at its entire discretion if, in particular, the products are not available, their prices are incorrect or they are not correctly described and cannot be held responsible in this case. Consequently, IRIS NOBLE will not be held responsible towards the customer or a third party for the errors or defects of the photographs or graphic representations of the IRIS NOBLE products presented on the site. Due to the nature of leathers and materials, color may vary. Variations in grain color or material and natural leather markings are not considered defects. As the manufacture and finishing of the bags is carried out by hand by leather craftsmen, the finishes and stitching may present some variations or irregularities.
Before purchasing, the customer must ensure that the product's materials do not contain any elements harmful to his or her health. All IRIS NOBLE products are made from carefully selected materials. Some of our models include magnets. Although we have never encountered any problems with our magnetic closures, as a precautionary measure we would like to remind you to avoid excessive proximity between any type of magnet and credit cards or electronic equipment. In particular, people with pacemakers should avoid contact with magnets.
IRIS NOBLE reserves the right not to accept an order from a customer with whom it is in dispute for a previous order, or if IRIS NOBLE reasonably believes that this customer has infringed the present General Conditions or that he has engaged in fraudulent activity, or for any other legitimate reason.
III - ORDERS
The acceptance of the order is subjected to the respect of the various stages set up by IRIS NOBLE and which the customer must follow to lead to the validation of his order.
The validation of the order is worth confirmation of the acceptance by the customer of all the clauses of these General Conditions of Sale.
An email of confirmation recapitulating the order (products, price, availability of the products, quantity, times of preparation of the order) will be addressed to the customer by IRIS NOBLE.
To this end, the Customer formally accepts the use of electronic mail for the confirmation by the company IRIS NOBLE of the contents of his order.
The customer has 15 (fifteen) calendar days to exercise his right of retractation as from the delivery of the parcel.
IV - PRICES AND TERMS OF PAYMENT
Product prices are available on request by e-mail or telephone and are quoted in euros.
All prices shown are exclusive of VAT, as this site is open to international customers. VAT is applied at the time of payment and according to the country of residence and delivery of the product.
For the EU, all prices include French value-added tax (VAT).
All prices outside the EU do not include VAT. Depending on the country, additional local taxes may be required. These will be charged to the customer.
The total price of the order, including shipping costs, is confirmed by e-mail and indicated on the pro-forma invoice attached to the payment request. The customer is responsible for customs clearance costs and the payment of any duties or taxes.
IRIS NOBLE reserves the right to modify its prices constantly but the products will be invoiced on the basis of the tariffs in force at the time of the recording of the order, subject to availability.
Products are payable at the time of order.
Payment is made by Paypal or by credit card via Stripe.
The Customer expressly recognizes that the communication of his bank card number to IRIS NOBLE is worth authorization of debit of his account up to the price of the ordered products.
The data recorded and preserved by IRIS NOBLE constitute the proof of the Order and the whole of the sales passed. The data recorded by Paypal and Stripe constitute the proof of the financial transaction.
V - DELIVERY
Deliveries are made by DHL, Fedex, UPS or Chronopost from Monday to Friday.
Delivery is made to the delivery address indicated by the customer, it being specified that this must be the residential address of the customer, of a natural person of his choice or of a legal entity (delivery to his company). Delivery cannot be made to hotels or post office boxes.
If the product ordered is available, orders are sent on average between 24 and 72 hours after confirmation of payment of the order, but this period may exceptionally be extended to 10 (ten) working days in certain specific cases.
Products should be delivered to the address provided by the customer at the time of ordering by either DHL, Fedex, UPS or Chronopost within a maximum of 2 to 30 working days from collection of the package.
If the delivery time is exceeded for reasons other than force majeure, the customer may, within a maximum of 15 (fifteen) days after expiry of the maximum delivery time (30 days), request cancellation of the sale and reimbursement of the amount paid. To be taken into consideration, this request must be notified by email to our Customer Relations Department (showroom@irisnoble.com). This situation excludes any other form of compensation.
The determination of the conformity of the returns compared to the original state of the product and the packaging sent is left to the entire discretion of IRIS NOBLE.
IRIS NOBLE cannot be held responsible for the consequences of a delay in delivery which is not its fault (customs...).
In order to meet these deadlines, the customer must ensure that he has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).
The customer must check the conformity of the products at the time of delivery and indicate, if possible on the delivery note, any handwritten reservations accompanied by his/her signature concerning any anomalies noted (open package, damaged product, etc.).
In the event of non-conformity of the products purchased or if they do not give satisfaction to the customer, the customer may return them or request an exchange or refund under the conditions set out in paragraph VI "Returns, exchanges and refunds".
Unfortunately, IRIS NOBLE cannot deliver to all countries. Customers should contact us to find out if their country is eligible.
VI - RETURNS, EXCHANGES AND REFUNDS
Within 10 days of reception of the order, the customer may request an exchange but not a refund. The return of the product(s) obligatorily carried out within 10 days is with the load of the customer and is under his whole responsibility and the exchange will take place only once the product(s) will have been received by IRIS NOBLE in perfect state.
The product must be returned in its original packaging, in its original condition, new, unworn, otherwise the exchange will not be granted. To make a return, the customer must contact us by sending an email to showroom@irisnoble.com.
In the event of exchange, the company IRIS NOBLE for the customer will intervene 15 (fifteen) days as from the effective reception with the store of the product (s) which the customer returns.
In the absence of respect by the customer of the present GCS, IRIS NOBLE will not be able to carry out the exchange of the Products concerned.
Special orders that have been personalized (color, leather, initials, etc.) cannot be returned for exchange or refund.
The determination of the conformity of the returns compared to the original state of the product and the packaging sent is left to the entire discretion of IRIS NOBLE.
VII - WARRANTIES AND LIABILITY
IRIS NOBLE has only an obligation of means, for all the stages of access to Internet site, of the process of order to the forwarding of the parcel or the posterior services. The responsibility for IRIS NOBLE could not be committed for all the disadvantages or damage inherent in the use of Internet network, in particular a rupture of the service, an external intrusion or the presence of computer viruses, or of any fact qualified as cause beyond control, in accordance with the law and the jurisprudence of the French courts. In the event of the occurrence of an event of force majeure preventing the execution of the present GCS, IRIS NOBLE will inform the customer within a period of fifteen (15) days as from the occurrence of this event, by e-mail or by registered letter with acknowledgement of receipt.
The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the case law of French courts and tribunals: total or partial strikes, confinement, riots, boycotts or other industrial actions or commercial disputes, civil unrest, insurrection, war, bad weather, epidemics, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes to forms of marketing, computer failure, blockage of telecommunications, including wired or wireless telecommunications networks, and any other event beyond the control of the parties preventing the normal performance of the contractual relationship. All obligations of the parties are suspended for the duration of the force majeure event, without compensation. If the event of force majeure continues for more than three (3) months, the transaction concerned may be terminated without compensation on either side.
In accordance with the French Consumer Code Order 2005-136 of February 17, 2005, all applicable texts are listed below.
- Art. L. 211-4. of the French Consumer Code: "The seller is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when the latter has been made his responsibility by the contract or has been carried out under his responsibility."
- Art. L. 211-5. of the French Consumer Code: "To be in conformity with the contract, the good must: 1° Be fit for the use usually expected of a similar good and, where applicable: a) correspond to the description given by the seller and possess the qualities that the latter has presented to the Customer in the form of a sample or model; b) present the qualities that a Customer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling. 2° Or present the characteristics defined by mutual agreement between the parties, or be suitable for any special use sought by the Customer, brought to the attention of the seller and accepted by the latter."
- Art. L. 211-12. of the French Consumer Code: "Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.
- Art. 1641 of the French Civil Code: "The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the customer would not have purchased it, or would only have paid a lower price for it, had he been aware of them".
- Art. 1648 paragraph 1 of the Civil Code: "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
Our products are made from leather, which means that each hide is unique and has its own specific color, natural mark and stripe, and the appearance of the hide is likely to show scratches.
Leather irregularities and scratches are not considered defects.
As the bags are handmade and finished by leather craftsmen, the finishes and stitching may vary or be irregular.
VIII - OTHER PROVISIONS
If one or more of the stipulations of these GTC are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.
The fact that the IRIS NOBLE company refrains from requiring at a given moment the execution of any of the stipulations of the present general conditions of sale cannot be interpreted like being worth renunciation to invoke the aforementioned total or partial non-execution later.
The present CGV can be modified constantly and without notice by IRIS NOBLE. The applicable CGV are those in force at the date of the order by the customer.
IX - APPLICABLE LAW
All orders are subject to the customer's acceptance of the General Terms and Conditions of Sale, which are governed by French law. In the event of a dispute or complaint, we ask the customer to first contact our customer service department to try to reach an amicable agreement.
In the event of a dispute, the French courts shall have exclusive jurisdiction to resolve it.
X - LEGAL INFORMATION
It is reminded that the secrecy of correspondence is not guaranteed on the Internet and that it is the responsibility of each Internet user to take all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Internet or from hacking.
